In the recent Legaltech News article, “Consilio Lawsuit Highlights Common E-Discovery Risk: Over-Collecting Data,” Jonathan Redgrave addresses the complicated nature of the eDiscovery and the tendency to use over-collection as a substitute for a comprehensive eDiscovery strategy.

To be sure, collections isn’t only challenging for e-discovery software.  Insufficiently planned protocols or miscommunication can also lead forensic analysts to download too much data to avoid missing relevant information, said Jonathan Redgrave, managing partner of e-discovery and information governance boutique Redgrave.

“There’s a lot of people involved and I think honest mistakes happen,” Redgrave said.  “I think it’s a stretch to jump to conclusions that people are trying to harm but I think the reality is, in discovery, there’s a lot of steps.”
