On February 23, 2022, Martin T. Tully will participate in the panel, “Discovery Scoping and Proportionality Analysis Just Got Easier,” hosted by the Association of Certified E-Discovery Specialists (ACEDS).  The panel, which consists of corporate, law firm, provider, and judiciary perspectives, will discuss Discovery Proportionality Model: A New Framework recently released for public comment by The George Washington University Law School.  The goal of the New Framework is to create a practical proportionality relevancy-and-burden assessment model that, if widely adopted, will facilitate a more transparent and less contentious discovery process.  Topics of discussion include:

  • Case law and the challenges of proportionality
  • How this model gives you the keys to negotiate from a position of strength
  • When and how to start your proportionality analysis
