On January 26, 2022, Monica McCarroll will speak at the Women in eDiscovery - D.C. Chapter 2021 Case Law Retrospective.  This compilation of 2021 case law will examine key cases and highlight their practical implications for eDiscovery practice and procedure.  Monica will discuss the top ten eDiscovery cases of 2021 and highlight how courts approached proportionality under the 2015 Rules; how privilege logging is still not uncomplicated despite the Rule 502(d) protections; and the challenges conducting discovery associated with mobile devices, social media, and other forms of communication like Slack, Teams, etc.  Monica will also review the blockbuster sanctions case from the Northern District of Illinois, DR Distributors v. 21 Century Smoking, Inc., a cautionary tale about counsel who failed to take their duty of competence seriously when conducting discovery under the FRCP.
