INDUSTRY EXPERIENCE:

Adam I. Cohen serves our clients with a unique blend of expertise and experience as a lawyer and cybersecurity professional.  His practice spans the spectrum of legal risk management, investigative and litigation response issues involved in cybersecurity, data privacy, electronic discovery, and information governance.  A former litigation partner with an Am Law 100 law firm, where he represented global businesses in complex litigation involving intellectual property disputes and other legal issues, Adam is also a certified professional in information systems security (CISSP), cloud security (CCSP), and Ethical Hacking (CEH).  After spending more than a decade as a litigator, he spent an equal number of years in senior positions with leading consulting firms.

Adam’s approach is driven by his integrated understanding and knowledge of law and technology, informed by his extensive experience in investigations and litigation for corporate clients.  His entire career has been focused on serving business enterprises.  After many years helping clients with the regulatory or litigation fallout from high-risk situations like responding to data breaches, investigations and lawsuits, Adam applies proven, “battle-tested” methodologies and techniques to provide proactive guidance in managing risk and preparing for threats.  According to Adam: “The global proliferation of regulation in cybersecurity, as well as an active litigation environment with so many unresolved questions, means that every cybersecurity decision or omission has legal implications.  Technology and law are unavoidably becoming increasingly intertwined.  Ideally, enterprise clients should have legal advisors who are also cybersecurity professionals.”

Examples of how Adam has leveraged his hybrid law and technology knowledge and background to help clients include:

  • Advising global financial services companies in developing, documenting, implementing, assessing and testing comprehensive, enterprise information security programs for security and legal compliance with requirements, such as the New York Department of Financial Services Cybersecurity Requirements for Financial Services Companies (“NYDFS cybersecurity requirements”), the European Union General Data Protection Regulation (“EU GDPR”) and other applicable laws and regulations.
  • Advising clients dealing with regulatory investigations in the aftermath of data breaches resulting in the disclosure of Personally Identifiable Information (PII).
  • Responding to and investigating cybersecurity compromises involving insiders, intellectual property theft and more.
  • Acting as outsourced Chief Security Officer under the NYDFS cybersecurity requirements and the EU GDPR.
  • Appearing in federal court as an expert witness, for the defense, on the use of predictive coding in electronic discovery in a class action.
  • Bringing clients into compliance with the EU GDPR.
  • Serving as a court-appointed (by Hon. Shira A. Scheindlin (ret.)) neutral eDiscovery expert in Floyd et al. v. City of New York et al. (the NYPD “stop and frisk” case).
  • Leading computer forensics teams in Major League Baseball’s investigation of performance enhancing drug use.
  • Advising some of the largest private equity and hedge funds on legal compliance issues relating to technology, as well as providing them digital forensics and electronic discovery services during regulatory investigations and litigation.

THOUGHT LEADERSHIP:

  • Co-wrote the annually updated legal treatise “Electronic Discovery: Law and Practice,” first published in 2004 and cited as authority in several landmark federal court opinions.
  • Authored “Social Media: Legal Risk and Corporate Policy,” and co-authored two other books on electronic discovery, information governance and related issues.
  • Teaching future lawyers about law and technology for more than a decade, including currently at Fordham Law School and Cardozo Law School in New York.
