Ten Years Gone: Charting the Course of Proportionality in Discovery Under the Federal Rules of Civil Procedure and What Can Tip the Scales
On January 9, Martin Tully joins the Practising Law Institute program “Ten Years Gone: Charting the Course of Proportionality in Discovery Under the Federal Rules of Civil Procedure and What Can Tip the Scales.”
The Federal Rules of Civil Procedure are intended to further the “just, speedy, and inexpensive determination” of civil actions. Since 2015, the Rules have also explicitly addressed the scope of discovery in terms of both relevance and proportionality, describing six factors to be considered by judges in deciding whether discovery requests are or are not proportional to the needs of a particular action. This session will examine the evolving concept of proportionality over the past decade, the weight courts typically give the factors, and will suggest best practices for attorneys who argue whether or not discovery is proportional.
