On July 12, 2023, David Shonka will participate in the webinar “Challenging the Constitutionality of FTC & Other Federal Administrative Enforcement Proceedings,” hosted by the Beverly Hills Bar Association.  The panel will discuss Federal Trade Commission (FTC) civil enforcement proceedings in the areas of antitrust and consumer protection in light of the U.S. Supreme Court’s 2022 ruling in Axon Enterprise, Inc. v. FTC that opened the doors of federal district courts to litigation challenging the constitutionality of civil enforcement proceedings brought by the FTC or Securities and Exchange Commission (SEC) before their own administrative law judges.  Drawing on his previous experience as the Acting General Counsel for the FTC, David will discuss how the FTC administrative enforcement process works from the perspective of both the agency and organization subject to the enforcement action.
