White House AI Legislative Framework: What It Says — and What It Doesn’t

In March 2026, the White House released its “National Policy Framework for Artificial Intelligence — Legislative Recommendations” (the “Framework”), a seven-pillar set of proposals urging Congress to enact comprehensive AI legislation.  The Framework addresses children’s safety, intellectual property, innovation, state preemption, and workforce development.  But for corporate legal teams, the document’s significance lies less in what it proposes than in what it omits: it contains no statutory text, no defined terms, no risk classification system, and no implementation mechanisms.  Every consequential design decision is deferred to a legislative process that, amid bipartisan fractures and the approaching November midterms, is unlikely to produce comprehensive legislation before 2027 at the earliest.

The Developer Liability Shield: Reshaping Risk Across the AI Supply Chain

The most consequential provision, “States should not be permitted to penalize AI developers for a third party's unlawful conduct involving their models,” would establish a liability shield for AI model providers along the lines of Section 230 of the Communications Decency Act, fundamentally restructuring risk allocation across the AI supply chain and shifting accountability pressure onto deployers and end users.

This provision warrants close attention for organizations that deploy third-party AI models.  A developer liability shield would diminish providers’ legal incentives to implement downstream safeguards such as use-case restrictions, output filtering, and contractual compliance obligations, leaving these organizations to bear a greater share of the legal and reputational risk for harmful outputs and making robust internal governance programs not merely advisable but essential.

State Preemption: Aspiration Meets Political Reality

The Framework calls for broad federal preemption of state AI laws that “impose undue burdens,” while preserving state authority over traditional police powers, zoning, and government procurement.  The tension between these two objectives remains entirely unresolved, with the Framework failing to define “undue burden” or to specify which existing state laws would survive preemption.  That resolution is unlikely to come soon: preemption faces opposition from a bipartisan coalition that includes over fifty House Republicans. Meanwhile, Colorado, California, Utah, and Texas have enacted AI-specific legislation, and the pace of state-level activity continues to accelerate.  Organizations should not plan as though state compliance obligations will disappear.

No New Regulator — But No Simpler Landscape

The Framework rejects a dedicated federal AI regulatory body, recommending instead that existing sector-specific agencies oversee AI within their respective domains.  This trades one compliance patchwork, fifty state laws, for another: dozens of federal agencies, each developing its own AI-specific guidance, enforcement posture, and interpretive frameworks.  For multi-sector organizations, this approach may not simplify the regulatory environment at all.

Intellectual Property: A Deliberate Non-Answer

On intellectual property, the Administration states its belief that training AI models on copyrighted material “does not violate copyright laws,” then immediately acknowledges that contrary arguments exist and defers the question entirely to the courts.  It further recommends that Congress take no action that would affect judicial resolution of the fair use question.  For rights holders and AI developers alike, the status quo, active litigation with no legislative guardrails, will continue.

Six Critical Gaps

Across its seven pillars, the Framework leaves unaddressed several issues that any operational AI governance program should address: it offers no definition of “AI” or “AI system;” no risk-based classification framework; no transparency or disclosure requirements for AI-generated outputs; no accountability or audit mechanisms; no treatment of agentic AI systems that act autonomously; and no guidance on organizational governance structures.  These omissions mean that voluntary frameworks, including the NIST AI Risk Management Framework, existing legal obligations, and sector-specific regulatory guidance will remain the primary governance substrate for the foreseeable future.

The Framework is a political signal, not a compliance event.  It does not change the rules under which organizations operate today.  Organizations navigating AI governance should draw the following conclusions:

  • Do not wait for federal legislation.  The gap between this Framework and enacted law is substantial.  Voluntary governance frameworks, existing legal obligations, and sector-specific regulations remain the operative compliance baseline for the foreseeable future.
  • Assess downstream risk allocation now.  Organizations should stress-test their AI vendor contracts, internal use policies, and incident response protocols against a scenario in which model providers bear limited liability for downstream misuse.
  • Treat state AI laws as durable.  Federal preemption faces significant political obstacles and should not be treated as a near-term planning assumption.  Organizations with operations in Colorado, California, Utah, Texas, and other states with pending AI legislation should maintain compliance programs accordingly.
  • Map your sector-specific exposure.  Without a centralized federal regulator, AI oversight will be distributed across existing agencies, each developing independent guidance in healthcare, financial services, employment, and other domains.  Organizations should identify which regulators have jurisdiction over their AI use cases and monitor each agency’s emerging guidance.
  • Fill the governance gaps internally.  The Framework’s silence on AI definitions, risk classification, transparency, accountability, and agentic AI means that organizations must address these issues through their own governance programs, informed by frameworks like the NIST AI RMF, rather than waiting for legislative direction.
