Data Expert in Trade Secret and Non-Compete Dispute

We were engaged as the data expert in a dispute involving alleged breaches of contractual and non-compete obligations arising from a purchase agreement, with trade secret claims brought under the Delaware Uniform Trade Secrets Act (DUTSA).  

Our team conducted a comprehensive analysis of forensic evidence, internal systems, and email archives; interviewed technical personnel; and prepared and submitted two expert reports identifying key communications and the exfiltration of confidential information.  Following each report, our expert was deposed, prepared trial demonstratives, and testified at trial.

Our findings served as a foundational component of the opinions offered by two additional expert witnesses, a forensic accountant/damages expert and an industry expert, both of whom relied on our analysis to complete their reports and inform their testimony at trial.  The court largely denied a motion to exclude our expert’s testimony and relied on the testimony in its post-trial opinion.  The matter resulted in a final judgment of nearly $70 million, including exemplary damages awarded under DUTSA for willful and malicious misappropriation.
